Justices are controversial. There is no one agreed upon philosophy.

Justice Scalia was not objectively better than either of Obama's nominees, nor the other way around. None of the justices work free of ideology, and Justice Scalia was no exception. He was a very controversial figure, but he was a qualified candidate when he was nominated by Raegan, and as such, he was UNANIMOUSLY confirmed by the Senate.

It is the President's duty to nominate a replacement, and the Senate's duty to hold a hearing and vote on confirmation in due course. This process is far from apolitical, but generally, it is one of the great traditions in American governance that the Senate confirm objectively well-qualified candidates nominated by the President.

All of this is to say that it is entirely warranted for people, regardless of their ideology, to be outraged by congressional republicans announcing in advance that they will block any Obama appointee, before his nomination is even announced. This is what it is, and that is blatant, unprecedented partisan gamesmanship. Mitch McConnell said that the American people should have a say in who is appointed. I ask, what about the people who reelected Obama in a decisive victory in 2012? If the republicans go through with their plan to block Obama's appointment, they are retroactively stripping those voters of their say in the matter.

There's no spinning it, DB. Left or right, this is flat wrong.
