Fifth Circuit rules Texas can penalize Websites for shutting down speakers

This is truly an insane time. Now hosts of forums can be sued for blocking a speaker. The idea that Texas can pass a law that permit suits against a private party because that party has its own rules about who can and cannot use and publish its website is simply balderdash.

The first amendment is at a weird and scary place. A Catholic has every right to tell women that they cannot access birth control pills though his health plan. A Jewish college is permitted to shut its doors to homosexuals. But - hosts of internet forums are precluded from regulating the use of the web site that they own?

Before you go into arguing about the claimed liberal slant somehow justifying it - why doesn't the conservative bias against birth control or homosexuals matter? And to get you bent even more out of shape - my (educated) guess is the posts giving rise to suspension are far more prevalent in the conservative community.

All of that said - none of it matters. The most fundamental point is no one has a right to speak using my property or my forum if I do not want them to. That is MY first amendment right.
