Great question..

I don't think Roe v. Wade will ever truly be in danger of being overturned. I think it is a talking point used by politicians to motivate people in elections. Prior to expanding the court, I'd pass the filibuster and see what that does to 'crossing the aisle'. If that does nothing, I'd expand the states (Add PR, Guam and DC) prior to touching the Supreme Court. You get more bang for the buck in terms of holding down Republican majority. That will also likely force the Republican Party to reinvent itself....
