That's an interesting argumrnt, but most likely yes

As a general matter, the duty to mitigate doesn't require the terminqted employee to look for a job at exactly the same level that he/she hed prior to termination. The law may be different when dealing with a contract like this with a narrow offset provision. I'd still feel pretty confident arguing that MM is entitled to everything if I was his lawyer.
